EarthLink AVL Developer Contest Official Rules

  1. The EarthLink AVL Developer Contest (the "Contest") commences July 1, 2001 and ends December 31, 2001.
  2. Enter the Contest by submitting an e-mail with a detailed description of your proposed application for the EARTHLINK SPARK AVL unit to avlcontest@research.earthlink.net, or by mailing your entry to AVL Contest/R&D, 3100 New York Drive, Pasadena, CA 91107. EarthLink, Inc. is not responsible for incomplete, late, lost, misdirected or postage-due mail or for any technical malfunction, human error, lost/delayed data transmission, omission, interruption, deletion, defect, or line failure in connection with any telephone network, computer equipment, software or any combination thereof. You may enter as many times as you like. All entries must be received by December 31, 2001.
  3. All eligible entries received during the contest term will be judged by EarthLink based on the following factors: originality, utility, ease of use, functionality, creativity, compatibility, and overall appeal. Each entry must meet the following Entry Requirements:
    • Use of EARTHLINK SPARK AVL APIs (in-vehicle or middleware)
    • Documentation with information on use of the application
    • Contestant's name, e-mail, postal address, and contact telephone number
    • Each entry must be original and must be written by the Contestant.
    • EarthLink, Inc. will not return any entries to Contestant.
    One winner will be selected in each of the following categories: Overall Favorite Application, Navigation, Directory, Entertainment, Security, and M-commerce. All decisions of EarthLink, Inc. are final and binding. The judges will determine the contest winners within 30 days of the end the contest. The winner will be notified within 15 days of the judges determination. The winner will have 30 days from the date of notification to accept the prize. EarthLink shall not be responsible for and shall not be liable for late, lost, misdirected, or unsuccessful entries and/or efforts to notify winner.
  4. By accepting and/or using prize, winner agrees to allow EarthLink, Inc. to use the winner's name, voice, and/or likeness for the purpose of advertising, publicizing, or otherwise promoting the contest, EarthLink, Inc. or any services, products or other offerings of EarthLink, Inc. without further compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to return the completed and executed declaration and releases where required within 30 days, the prize will be forfeited and an alternate winner selected.
  5. Promotion valid only in United States to residents over the age of eighteen as of July 1, 2001.
  6. Employees (which shall include all immediate families members of an employee and people living in the same household) of EarthLink, Inc. and its subsidiaries, affiliates, agents, resellers, dealers and related parties , are not eligible.
  7. All federal, state and local laws and regulations apply. Void where prohibited by law.
  8. All federal, state and local taxes are the sole responsibility of the winner.
  9. EarthLink, Inc., its affiliates, subsidiaries, agents, resellers or dealers are not responsible for, and the winner hereby releases EarthLink, Inc., its affiliates, subsidiaries, agents, resellers or dealers from any costs, liabilities, damages, taxes, or expenses resulting from the winner's participation in this contest or otherwise as a result of this contest or receipt and/or use of prize, including liability for personal injury to the winner or to third parties. Entries are void if unreadable, inaccurate, incomplete, mutilated, tampered with, forged, mechanically reproduced, irregular in any way, or otherwise not in compliance with these rules. If for any reason the program is not capable of running as planned, the Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the program.
  10. Prizes are awarded on the condition EarthLink, Inc., its affiliates, subsidiaries, agents, resellers or dealers will have no liability as a result from any injuries, losses or damages of any kind resulting from the winner's acceptance, use and/or possession of any prizes.
  11. No purchase is necessary to enter or win the Contest. All entries must be received by December 31, 2001.
  12. Entrant warrants that the entry is original, that no false information is given, and that no other person owns or has any rights to any element of the entry including any copyrights in it. All entries must be original. Entries must be in keeping with EarthLink Inc.'s image and may not be offensive, as determined by the judging panel at its sole discretion. The entrant shall retain all intellectual property rights and commercial rights in the entry. However, EarthLink Inc. reserves the right to use materials contained within entries for promotional and demonstration purposes without prior notice or compensation (including, but not limited to magazine articles, web sites and conferences). EarthLink, Inc. shall not be subject to any confidentiality obligations in respect of the content of any entry submitted. Nothing contained in any entry shall prevent EarthLink, Inc. from carrying out or exploiting its own development programs (whether already in existence or otherwise). Sponsor reserves the right to correspond with any entrant, via mail or email, but is not required to do so in any instance.
  13. By participating in the Contest each participant agrees to the terms set forth within the above stated rules and regulations.
  14. Odds of winning will be determined by the number of eligible entries received.
  15. To obtain a list of winners, send a self-addressed, stamped envelope to EarthLink, Inc. AVL Contest Winners/R&D, 3100 New York Drive, Pasadena, CA 91107.
  16. Contest Prize:
    The judges shall pick six (6) winners from the qualified, available entries, one from each of the following categories: Overall Favorite Application, Navigation, Directory, Entertainment, Security, and M-commerce. Each of the winners shall receive an EarthLink AVL in-vehicle prototype unit. The winner in the Overall Favorite Application category will receive one full year of free AVL wireless service, and may choose one of the following: 1 year of EarthLink DSL or Cable access (where applicable); or RIM 957 wireless handheld plus 6 months service; or $500 cash. Winners in the best Navigation, Directory, Entertainment, Security, and M-commerce categories will receive three months of free AVL wireless service and may choose one of the following: 1 year of free EarthLink dial-up access; or RIM 950 wireless handheld plus 3 months service; or $250 cash.
